In short
Powe is a recording and social app for skiing and snowboarding. It is not safety equipment and must not be relied on in an emergency.
You are responsible for your own decisions on the mountain, and for only sharing another person's location with their agreement.
Premium features are sold as a subscription through the app stores, and you cancel through the store rather than through us.
This document is published in English, and the English version is the one that applies. A translation will follow once it has been reviewed.
1. Safety: Powe is not a safety device
Read this section before you rely on the app for anything.
Powe cannot locate you or anyone else buried under snow. It is not an avalanche transceiver and is no substitute for one.
Sharing a position requires a mobile signal. On a mountain there is frequently none, and a position that fails to send is not visible to anyone.
Phone batteries fail quickly in the cold, and a flat phone shares nothing.
Positions, altitudes, run detection and piste names are estimates produced from consumer sensors and third-party map data. They can be wrong.
Nothing in the app tells you whether terrain is safe, whether a slope is open, or what the avalanche risk is.
For off-piste and backcountry travel, carry a transceiver, probe and shovel, know how to use them, and carry a satellite messenger or personal locator beacon. Check the avalanche forecast. Do not enter avalanche terrain on the basis of anything this app shows you.
Skiing and snowboarding are inherently dangerous. You accept that risk, and you remain solely responsible for your decisions, your route choices and your safety.
2. These terms
These terms are an agreement between you and TODO_BEFORE_LAUNCH ("we", "us"), and they govern your use of the Powe apps and website (the "Service"). By creating an account or using the Service you accept them. If you do not accept them, do not use the Service.
Our Privacy Policy explains what we do with your personal data and forms part of these terms.
3. Your account
You must be at least 13 years old, or older where your local law requires it, to have an account.
You sign in through Google or Apple. Keep that account secure, because whoever controls it controls your Powe account.
You are responsible for what happens under your account.
You can delete your account at any time from inside the app.
4. What the Service does, and what it does not promise
Powe records ski and snowboard activity using your device's location and pressure sensors, estimates your runs and lift rides, and can show your live position to groups you choose.
We do not promise that recording will be complete or accurate, that detection will identify every run, that piste and lift names will be correct, or that the Service will be available without interruption. Operating systems suspend background activity, batteries die, signal drops, and sensors are imprecise.
5. Acceptable use
You agree not to:
Use the Service to track, monitor or locate a person without their knowledge and agreement. This includes setting up a device to share a position on someone else's behalf.
Share, publish or store another person's location data that you obtained through the Service, beyond the group features it provides.
Add someone to a group in order to obtain their location under a false pretext.
Attempt to access accounts, positions or data that are not yours, or work around the access rules that protect them.
Reverse engineer, resell or redistribute the Service, or use it to build a competing dataset.
Use the Service unlawfully, or where doing so would put you or anyone else at risk.
Location data about other people is sensitive. If you are in a group with someone, treat what you can see about them as private to that group.
6. Subscriptions and payment
Core recording, your own statistics and last-known-position for your group are free. Premium features are sold as an auto-renewing subscription and cover longer history, full-day replay, group reconstruction and track export.
Payment is taken by Apple or Google under their terms, not by us. We do not see your payment details.
A subscription renews automatically at the end of each period unless you cancel at least 24 hours before it ends.
You cancel and manage the subscription in your App Store or Google Play account settings. Deleting the app does not cancel it.
Refunds are handled by the store you bought through, according to its policy, and by any statutory right of withdrawal you have.
If prices change we will tell you before the change applies to you, and you can cancel.
We do not paywall safety. Recording your day locally and letting your group see your last known position remain free, because charging for the breadcrumb that matters in an emergency would leave the person without a subscription unprotected exactly when it counts.
7. Your data
Your recordings, profile and tracks are yours. You grant us only the permission we need to operate the Service for you: to store that data, process it to produce your statistics, and show what you have chosen to share to the groups you have chosen.
We do not claim ownership of it, and we do not use it to train models or sell it on.
8. Map data
Piste and lift names and geometry contain information from OpenStreetMap, made available under the Open Database Licence. OpenStreetMap data is contributed by volunteers, is not verified by us, and may be incomplete, out of date or wrong. Do not use it for navigation decisions that matter.
9. Changes and availability
We may add, change or remove features. If we make a change that materially reduces a paid feature you are currently paying for, we will tell you and you may cancel. We may suspend the Service for maintenance, and may discontinue it, in which case we will give reasonable notice so you can export your data.
10. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your account if you materially breach these terms, in particular the acceptable use section, or where we are required to by law. Where it is reasonable to do so, we will tell you first.
11. Disclaimers
To the fullest extent the law allows, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including as to accuracy, fitness for a particular purpose or uninterrupted availability.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud, or under your non-excludable consumer rights.
12. Limitation of liability
Subject to the paragraph above, we are not liable for indirect or consequential loss, for lost data or lost profits, or for any loss arising from your reliance on position, altitude, detection or map information produced by the Service. Our total liability arising out of or in connection with the Service is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty euros.
13. Governing law
These terms are governed by the law of TODO_BEFORE_LAUNCH, and its courts have jurisdiction. If you are a consumer, this does not deprive you of the protection of the mandatory consumer law of your country of residence, or of your right to bring proceedings there.
14. Changes to these terms
We may update these terms. If a change is material we will tell you in the app before it takes effect, and continuing to use the Service after that date means you accept the updated terms. The effective date at the top always shows the current version.
